Terms & Conditions
TUTORING AGREEMENT
This Tutoring Agreement ("Agreement") is entered into by and between Regina Readiness Academy (referred to as the "Tutor") and the Student or Parent (referred to collectively as the "Parties" and individually as the "Party"). This Agreement sets forth the arrangement between the Parties regarding the provision of tutoring services, which will commence upon receipt of payment, and is subject to the following terms and conditions:
FEES PAYABLE TO THE TUTOR
One-on-On Tutoring:

Fees payable will be reflected on invoice. No further fees shall be charged for traveling or preparation time of the Tutor.

Fees may be adjusted from time to time and shall become effective upon mutual Parties arrangement, after having given the Student 10 (ten) days prior written notice.
PAYMENT
Payment shall be made within seven (7) days of invoice being issued. Payment is accepted in the form of an e-transfer.
CANCELLATION OF LESSONS

By the student: If a lesson has been cancelled at least 12 hours before, the lesson will not be charged. If the cancellation notice time is not given, or the student fails to attend, no refund will be given.

By the tutor: In exceptional circumstances, a lesson may have to be cancelled and rescheduled, in which case the tutor will give as much notice to the student as possible.

Summer Camp: In exceptional circumstances, a summer camp may have to be cancelled, in which case a full refund will be issued.

We understand that illnesses and emergencies sometimes do not give you 12 hours notice. Exceptions may be made. Please contact your tutor ASAP.
LATE ARRIVAL AND CHANGE OF SCHEDULE

A Student/Tutor Does Not Show Up for an Appointment: In case of no-shows, Tutors and Students are only required to wait 15 minutes. Parents/guardians must confirm that their child is with the tutor before leaving them at the library.

Late Tutor: If a Tutor does not show up within 15 minutes of the appointment start time, the Student is entitled to a refund. If the Tutor shows up 15 minutes late, the Student is entitled to the missed time.

Late Student: If a Student does not show up within 15 minutes of the appointment start time, the Tutor is entitled to get paid for their time. If the Student shows up 15 minutes late, the Student will not be refunded for the missed time.

Leaving Early: If the Student needs to leave early, the Tutor will charge the full session rate and is under no obligation to make up any missed time. If the Tutor needs to leave early, the Student is entitled to the missed time.

Late Pick Up: Students are to be picked up promptly at the end of the tutoring session. Late pick up minutes will be counted and accumulated. Once an hour is reached, payment is expected. The tutor will not leave students under the age of 16 alone at the library.

OBLIGATIONS OF THE TUTOR

The Tutor undertakes to do all preparation prior to lessons and to structure lessons in such a way as to optimize time to the benefit of the Student.

The Tutor shall keep confidential information of the Student and shall contact other parties involved in the education of the Student only upon prior written permission of the Student.

The Tutor is not obliged to execute homework or assignments on behalf of the Student, however he shall do all his best to explain the material duly to enable the Student to do his/her homework properly.
OBLIGATIONS OF THE STUDENT

The Student undertakes to assist the Tutor in identifying problem areas in which the Student needs specific tutoring.

The Student undertakes to attend lessons and to do his best to gain knowledge and obtain new skills as well as to do his/her homework tasks assigned by the Tutor.

The Student agrees that assignments, exercises or homework are integral part of tutoring and undertakes to complete such work properly and timely.
WARRANTIES
The Tutor makes no promises or warranties with regards to a Student's performance as a result of any tutoring provided.

INDEPENDENT CONTRACTOR STATUS
All tutors engaged through this contract are independent contractors and not employees, agents, or representatives of Regina Readiness Academy. Tutors are not affiliated with any school division or educational institution. Each tutor is responsible for their own actions and methodologies in providing services under this contract. As independent contractors, tutors maintain full responsibility for any tax, insurance, and legal obligations arising from their earnings and conduct during their engagement.
GENERAL PROVISIONS
Entire Agreement. This Agreement contains the entire understanding of the Parties with respect to employment of the Babysitter and supersedes any and all prior understandings, written or oral. This Agreement may not be amended, waived, discharged or terminated orally, but only by an instrument in writing, specifically identified as an amendment to this Agreement, and signed by all Parties.
Relaxation of Terms. Any variation of the terms of this Agreement must be reduced to writing and signed by both Parties to the agreement.
Severability. If any provision of this Agreement shall be held to be illegal, invalid or unenforceable under present or future laws, such provisions shall be severable, this Agreement shall be construed and enforced as if such illegal, invalid or unenforceable provision had never comprised a part of this Agreement; and, the remaining provisions of this Agreement shall remain in full force and effect.
Termination. This Agreement may be terminated by either party at any time by giving the other party seven (7) days prior written notice.
Minors. In case if the Student is a legal minor, the Parent(s) shall enter into this Agreement on behalf of the Student and shall accept and agree to all the terms and conditions contained herein on behalf of the Student.
Dispute Resolution. If a dispute arises during or after the term of this Agreement between the Parties, they shall agree to negotiate amongst themselves, in "good faith", before any litigation.
